Title
An ordinance to repeal Ordinance No. 02-1-4, which approved a Railroad Crossing Agreement with Union Pacific Railroad Company and Esperanza Land Company and to repeal Ordinance No. 02-3-14, which authorized the Parish President to purchase and/or expropriate a servitude from Esperanza Land Company and Union Pacific Railroad.

WHEREAS, the Parish Council adopted Ordinance No. 02-1-4 on January 7, 2002 which approved and authorized the execution of a Railroad Crossing Agreement by and between Union Pacific Railroad Company, Esperanza Land Company and the Parish of St. Charles; and,
WHEREAS, said Agreement was never executed by the Parish President on behalf of St. Charles Parish; and,
WHEREAS, the Parish Council adopted Ordinance No. 02-3-14 on March 25, 2002 which authorized the Parish President to purchase and/or expropriate a servitude from Esperanza Land Company and Union Pacific Railroad Company; and,
WHEREAS, the Parish President has not filed an expropriation suit nor has he executed an Act of Sale for the purpose authorized; and,
WHEREAS, Esperanza Land Company and the Union Pacific Railroad Company executed a Railroad Crossing Agreement on June 17, 2002 to provide a road crossing at Sugarland Parkway, Luling which eliminates the need for both Ordinance No. 02-1-4 and Ordinance No. 02-3-14; and,
WHEREAS, it is the desire of the Parish Council to repeal said Ordinances.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Ordinance No. 02-1-4 adopted on January 7, 2002 and Ordinance No. 02-3-14 adopted on March 25, 2002 are hereby repealed and rescinded.
