Title
An ordinance to amend the St. Charles Parish Code of Ordinances, Chapter 16, Nuisances, Article II. Abandoned, Junked or Wrecked Vehicles, Sec. 16-11. Defined., to clarify the definition of "derelict automobiles by specifying that either lacking adequate registration or a current inspection sticker meets can qualify a vehicle under the definition.
Body
WHEREAS, the current definition requires both lacking current registration and a current inspection sticker; and,
WHEREAS, the current definition allows inoperable vehicles to circumvent the code by meeting a portion of the requirement; and,
WHEREAS, the test to determine operational status continues to require additional proof of inoperability; and,
WHEREAS, Code Enforcement will be better able to identify and manage incidents of derelict and inoperable automobiles.
NOW, THEREFORE, THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Code of Ordinances, Chapter 16, Nuisances, Article II. Abandoned, Junked or Wrecked Vehicles, Sec. 16-11. Defined., is hereby amended as follows with new text underlined and deleted text in strikethrough:
Sec. 16-11. Defined.
As used in this article the term "abandoned, junked, wrecked or derelict automobile or motor vehicle" shall mean a vehicle which does not have a current vehicle registration and or current inspection sticker, and either is not able to move under its own power or which has not been moved for sixty (60) days.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
