Title
An ordinance to amend Ordinance No. 07-12-24, a Cooperative Endeavor Agreement between the State of Louisiana Department of Transportation and Development and St. Charles Parish for the St. Charles West Bank Hurricane Protection Levee - Phase I Magnolia Ridge, State Project No. 579-45-0001.
Body
WHEREAS, on December 17, 2007, the St. Charles Parish Council adopted Ordinance No. 07-12-24 approving a Cooperative Endeavor Agreement with the State of Louisiana Department of Transportation and Development (LADOTD) for the St. Charles West Bank Hurricane Protection Levee - Phase I Magnolia Ridge, State Project No. 579-45-0001; and,
WHEREAS, pursuant to La. R.S. 49:214.5.2 (A)(1), the Coastal Protection and Restoration Authority represents the State of Louisiana's position relative to the protection, conservation, enhancement, and restoration of the coastal area of the state through oversight of integrated coastal protection projects and programs; and,
WHEREAS, pursuant to Act 523 of the 2009 Regular Legislative Session at Section 9, the Coastal Protection and Restoration Authority (CPRA) is assigned and subsumes all of the duties and responsibilities previously exercised by any other state agency with regard to previously executed agreements and contracts, the purposes of which are under the duties, jurisdiction, responsibilities, and powers granted to the CPRA; and,
WHEREAS, the CPRA desires to succeed to and assume the role for which LADOTD has been heretofore responsible and to which the CPRA has now been assigned by Legislative enactment; and,
WHEREAS, it has become necessary to amend the Cooperative Endeavor Agreement to transfer all rights, responsibilities, and obligations of the LADOTD to the CPRA, to change the State Project Number to OCPR-BA-85, to change the Project Description due to more imminent aspects of the St. Charles West Bank Hurr...
