Title
A resolution to acknowledge that St. Charles Parish opposes the use of excessive force by law enforcement agencies within the Parish against any individuals engaged in nonviolent civil rights demonstrations; and supports applicable federal, state and local laws against physically barring entrance to and from a facility or location which is the subject of such nonviolent civil rights demonstrations within the Parish.

WHEREAS, Section 104 (L)(1) of Title I of the Housing and Community Development Act of 1974 as amended (42 U.S.C. 69 ?5304) prohibits the obligation of authorized funds appropriated under Section 5303 to be obligated or expended to any unit of general local government that fails to 1. adopt or prohibit the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in nonviolent civil rights demonstrations or 2. fails to adopt and enforce a policy of enforcing applicable State and local laws against physically barring entrance to or exit from a facility or location which is the subject of such nonviolent civil rights demonstration within its jurisdiction; and,
WHEREAS, St. Charles Parish, as a recipient of Community Development Block Grant (CDBG) and other federal funding, acknowledges its responsibility to adhere to applicable federal, state and local regulations requiring units of government receiving CDBG funds to adopt and enforce "excessive force provisions."; and,
WHEREAS, the St. Charles Parish Sheriff's Office is a separate entity and not within the scope or control of the St. Charles Parish Governing Authority therefore the Parish President nor Parish Council have the legal authority to adopt or enforce "excessive force provisions"; and,
