Title
An ordinance to enact a Moratorium on the development of Major Subdivisions (five or more lots) within the Sunset Drainage District until such time as a Drainage Development Fee is implemented.
Body
WHEREAS, the further development of major subdivisions within the Sunset Drainage District has the potential to have detrimental and negative impacts on the public health, welfare, safety, well being, and property interest of residents from the potential hazards of adverse effects of proper drainage and flooding; and,
WHEREAS, in order to protect and preserve the health, welfare, safety, well being, and property interest of residents of the Sunset Drainage District it is necessary to impose a Moratorium on the development of major subdivisions within the District to allow for the adoption of legislation to assure that new development contributes its proportionate share of the cost of providing improvements to the Drainage system of the District.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That there is hereby imposed a Moratorium on the development of major subdivisions (five or more lots) within the Sunset Drainage District.
SECTION II. That this Moratorium shall affect all properties, regardless of zoning, within the boundaries of the Sunset Drainage District.
SECTION III. That this Moratorium shall apply to any major subdivisions, which have not received preliminary plat approval from the St. Charles Parish Planning & Zoning Commission prior to the adoption of this ordinance.
SECTION IV. That the Moratorium hereby imposed shall be in effect until June 30, 2005.
