Title
An ordinance approving and authorizing the execution of an Act of Revocation on property owned by Nathaniel L. Castillo and identified in the attached Act of Revocation and further identified as a portion of the Cajun Paradise Levee System.
Body
WHEREAS, on February 28, 2005, St. Charles Parish acquired a servitude from Allen Lottinger, Jr. and Lisa Wegmann Lottinger for the purpose of constructing, operating, maintaining, repairing and/or replacing a portion of the Cajun Paradise Levee System. Said servitude is recorded at COB 307, folio 727 in the records of the Clerk of Court of St. Charles Parish; and,
WHEREAS, on December 22, 2009, Allen Lottinger, Jr. and Lisa Wegmann Lottinger sold the property on which this servitude lies to Nathaniel L. Castillo which said sale reserved the Servitude in favor of St. Charles Parish and is duly recorded at COB 738, folio 290 in the records of the Clerk of Court of St. Charles Parish; and,
WHEREAS, the Department of Public Works has now determined that there is no longer a public purpose for this servitude, and it no longer serves a public need.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. The St. Charles Parish Council hereby approves the attached Act of Revocation by St. Charles Parish releasing the Donation of Servitude by and between Allen Lottinger, Jr. and Lisa Wegmann Lottinger and further sold to Nathaniel L. Castillo.
SECTION II. That the Parish President is hereby authorized to execute said Act of Revocation on behalf of St. Charles Parish, along with any other documents or instruments necessary to carry out the intent of this Ordinance.
