Title
A resolution to approve and authorize the execution of an Act of Conservation Servitude For Public Use and Benefit by Willowridge Estates, L. L. C. and Rathborne Land Company, Inc. over 373.7926 acres in Luling.
Body
WHEREAS, Willowridge Estates, L. L. C. and Rathborne Land Company, Inc. are the owners of Parcel 2B containing 27.8763 acres, Parcel 3B containing 31.5936 acres, Parcel 5 containing 10.9150 acres and Parcel 6A containing 303.4077 acres, all located in Luling; and
WHEREAS, in order to settle disputed wetlands issues with the U. S. Army Corps of Engineers the owners of said property have agreed to establish a Conservation Servitude over said property in accordance with the Louisiana Conservation Servitude Act (L.R.S. 9:1271-1276); and
WHEREAS, said act requires a "Holder" of said servitude; and
WHEREAS, the owners of said property have requested that the Parish of St. Charles be the holder of said servitude; and
WHEREAS, the owners have also agreed to provide the Parish with a Hold Harmless agreement for said property; and
WHEREAS, it is the desire of the Parish of St. Charles to accept said servitude.
NOW, THEREFORE BE IT RESOLVED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL AND THE PARISH PRESIDENT, do hereby approve the Act of Conservation Servitude For Public Use and Benefit by Willowridge Estates, L. L. C. and Rathborne Land Company, Inc. to the Parish of St. Charles over Parcels 2B, 3B, 5 and 6A located in Luling.
BE IT FURTHER RESOLVED that the Parish President is hereby authorized to execute said servitude on behalf of the Parish of St. Charles.
